High Court Opens the Door to Detention Compensation Claims
In June 2026, Australia’s High Court delivered a landmark ruling confirming that individuals held in indefinite immigration detention can sue the Commonwealth for false imprisonment. This follows the historic 2023 NZYQ decision that found indefinite detention illegal where removal is not reasonably foreseeable.
The ruling involved Austrian citizen Safwat Abdel-Hady, who was unable to fly due to a medical condition. Despite the government conceding he could not be removed from mid-2022, he remained detained until after the November 2023 NZYQ ruling.
What This Means
The Australian Lawyers Alliance estimates approximately 340 former detainees may now be eligible to claim compensation, with total liabilities potentially reaching tens of millions of dollars.
